NOTICE OF MEETING OF THE BOARD OF REVIEW
FOR THE VILLAGE OF LAKE DELTON
NOTICE IS HEREBY GIVEN that the Board of Review for the Village of Lake Delton, Sauk County, will be held on the 19th day of July, 2010 at 1:00 P.M. at the Kay C Mackesey Administration Building, 50 Wis Dells Pkwy South.
The last day to file objection forms , is July 16, 2010.
Please be advised of the following requirements to appear before the Board of Review and procedural requirements if appearing before the Board:
No person shall be allowed to appear before the Board of Review, to testify to the Board by telephone or to contest the amount of any assessment of real or personal property if the person has refused a reasonable written request by certified mail of the Assessor to view such property.
After the first meeting of the Board of Review and before the Board’s final adjournment, no person who is scheduled to appear before the Board of Review may contact, or provide information to a member of the Board about the person’s objection except at a session of the Board.
No person may appear before the Board of Review, testify to the Board by telephone or contest the amount of assessment unless, at least 48 hours before the first meeting of the Board or at least 48 hours before the objection is heard if the objection is allowed because the person has been granted a waiver of the 48-hour notice of an intent to file a written objection by appearing before the Board during the first two hours of the meeting and showing good cause for failure to meet the 48 hour notice requirement and files a written objection, that the person provides to the Clerk of the Board of Review notice as to whether the person will ask for removal of any Board members and, if so, which member will be removed and the person’s reasonable estimate of the length of time that the hearing will take. For the year 2010, the last day to submit an assessment objection is July 16, 2010.
Each taxpayer who submits an objection, and the assessor shall present to the board of review all evidence, as specified in the Wisconsin Property Assessment Manual under s.73.03 (2a), Wis. Stats., and subsection (b) to support their resprective positions.
A taxpayer submitting an objection may request an extension of 60 days before the hearing on his objection. The request for extension must be in writing and a $100.00 filing fee is required per tax parcel.
The taxpayer must provide the following additional information in support of the objection:
A statement identifying with specificity alleged errors by the assessor in assessing the property with references to the Wisconsin Property Assessment Manual, state statutes or appellate court decisions supporting the claim.
Information on a recent arm’s length sale of the subject property, and comparable properties, including an accounting of any physical changes made to the property between the sale date and the January 1 assessment date.
Documentation on the adjustment for any change in market value due to the time between the purchase date and assessment date.
Copies of all appraisals within the past three (3) years. The appraiser may be required to attend the board of review hearing to justify the appraised value.
If the property is currently for sale, a statement of the asking price or listing contract.
A replacement cost estimate of the property’s value, less any depreciation.
An income approach to value for income producing properties with supporting documentation, including tax returns and detailed income and expense information for the past five (5) years; all lease terms and conditions, and the method of determining the capitalization rate.
Identification and explanation of facts or conditions which may affect the property’s Market Value, such as size and location of the land, zoning restrictions, easements, environmental impairments, size and age of buildings, original cost of buildings, mortgage amounts, casualty insurance coverage or any other facts or conditions that may be relevant to the property’s market value.
A detailed audited asset listing for all personal property within the jurisdiction, for personal property appeals.
Such other information deemed appropriate by the board of review.
No person may appear before the board of review, testify to the board by telephone or object to a valuation if that valuation was made by the assessor or the objector using the income method unless the person supplies to the assessor all of the information about income and expenses, as specified in the Wisconsin Property Assessment Manual, that the assessor requests. The Village of Lake Delton has an ordinance for the confidentiality of information about income and expenses that is provided to the Assessor under this paragraph which provides exemptions for persons using information in the discharge of duties imposed by law or of the duties of their office or by order of a court. The information that is provided under this paragraph, unless a court determined that it is inaccurate, is not subject to the right of inspection and copying under 19.35(1) of Wis. Statutes.
The Board shall hear upon oath, by telephone, all ill or disabled persons who present to the Board a letter from a physician, surgeon or osteopath that confirms their illness or disability. No other persons may testify by telephone.
This notice is published in accordance with the provisions of 70.47 (7) (c)Wis. Stats. and Chapter 11.66 Village Municipal Code.
